\nThe European Court of Human Rights is an international body of the Council of Europe that considers applications from persons who complain about violations of their rights and freedoms. The conditions for consideration of applications are determined by the European Convention for the Protection of Human Rights and Fundamental Freedoms of 1950. The Convention is an international treaty under which most European states have committed themselves to respecting human rights and fundamental freedoms.<\/p>\n

Fundamental human rights are defined and their protection is guaranteed directly by the Convention itself, as well as by its additional protocols (Protocols 1, 4, 6, 7, 12 and 13), the binding nature of which has been approved by States parties to the Convention.<\/p>\n

Ukraine ratified the Convention on July 17, 1997 by Law No. 475\/97-VR. Ukrainian regulations determine only the procedure for enforcing decisions of the European Court, and the grounds and procedure for applying to the Court of individuals and legal entities from Ukraine or with claims to Ukraine are determined exclusively by the Convention and its Protocols.<\/p>\n

Any natural or legal person who is not a public body (enterprise, non-governmental organization) may apply to the Court if he considers that his rights or fundamental freedoms provided for in the Convention have been violated by any of the States parties to the Convention. .<\/p>\n

It should be noted in particular that the Court does not perform the functions inherent in national courts, nor does it have the power to set aside or amend decisions of national courts. Nor can the court directly interfere in the activities of an authority whose action or omission has resulted in a violation of rights or freedoms. That is, if you have been tried in Ukraine and you do not like the decisions made by the Ukrainian courts, the European Court will not decide whether the decisions were correct or not, will not change or cancel them, and will not even require the state. The court will also not give instructions to the Ukrainian authorities. The Court clarifies only one question: have your rights and freedoms under the Convention been violated?<\/p>\n

If your rights and freedoms have been violated, the Court awards fair satisfaction to Ukraine in your favor. It should be noted that the Court usually appoints a fairly substantial satisfaction.<\/p>\n
