The writ of execution must meet the requirements for the writ of execution established by the Law of Ukraine “On Enforcement Proceedings”. However, there are cases when due to an error made during its registration or issuance, the executive document cannot be executed. In this case, you need to go to court with a statement to correct the error.<\/p>\n

The court considers such an application within ten days in court with the notification of the debt collector and the debtor. The non-appearance of the debt collector and the debtor is not an obstacle to the consideration of the application.<\/p>\n

STATEMENT<\/strong><\/p>\n

24.05.2016 The Nikolaev district court of the Lviv region issued the writ of execution on the case on the claim of Ivanova OV to Ivankiv village council of the Nikolaev area of \u200b\u200bthe Lviv region about compensation of property damage.<\/p>\n

During the verification of the court decision it was established that an error was made in the execution of the writ of execution: incorrect identification of the debtor (USREOU code Ivankivska village council of Lviv region) – 22222222 instead of 11111111, as well as incorrect current account number of the debtor.<\/p>\n

In view of the above and guided by Art. 18 of the Law of Ukraine “On Enforcement Proceedings”, Art. 369 GIC of Ukraine,<\/p>\n
