Housing and communal services are services that we face every day. These are services for cleaning of indoor premises and adjacent territory, sanitary maintenance, maintenance of internal networks, lighting of common areas, current repairs, as well as services related to water supply and sewerage, gas and electricity supply, heating, household waste disposal.
\nA personal account is a kind of identifier of a consumer of housing and communal services. On the personal account you can get information about the accrual, track payments and submit the indicators of the meter. As a rule, the above data are currently available online.<\/p>\n
In the case where the property is jointly owned by several persons, a personal account is issued to one of the co-owners, but the obligation to pay for housing and communal services is borne jointly by all co-owners.
\nThere are often cases when the co-owners do not agree to pay for the received housing and communal services, someone refuses to participate in the payment for services. In this case, the question arises about the distribution of personal accounts.<\/p>\n
As follows from the provisions of the Rules for the use of residential buildings and dormitories, approved by the Resolution of the Cabinet of Ministers of 08.10.1992. \u2116 572 (item 10), Rules for the use of centralized municipal water supply and sewerage systems in settlements of Ukraine, approved by the order of the Ministry of Housing and Communal Services of Ukraine dated 27.06.2008. 90190 (p.3.9), Rules for the provision of gas supply services, approved by the resolution of the Cabinet of Ministers of 09.12.1999. \u2116 2246 (clause 4) opening of separate personal accounts for each of the co-owners is possible only after allocation of shares of each of the co-owners in kind and installation of separate metering devices for water, gas, electricity and heat consumption.<\/p>\n
If the dwelling is not privatized, but is in state or communal ownership, then the question should be raised not about the distribution of personal accounts, but about the conclusion of a separate lease agreement for one of the family members.<\/p>\n
As can be seen from the provisions of housing legislation of Ukraine, the conclusion of a separate lease agreement for one of the family members is allowed if the living space accounted for by him can be allocated in the form of a separate apartment or other isolated room consisting of one or more rooms . The legislator also provided for the need to comply with the minimum norms of living space, which is 13.65 sq.m.
